Regarding purchases made on the site https://www.cyalume.shop, the customer accepts that all statements, notices, information and other communications are transmitted electronically and have the same probative value as exchanges by registered mail with acknowledgment of receipt.
These terms of sales may be subject to change, and any changes will only apply to orders placed after the date of its entry into force.
Products and availability
The characteristics of the sold products are presented in the dedicated pages of the website https://www.cyalume.shop. The offered products comply with European marketing standards. CYALUME TECHNOLOGIES cannot be held responsible for non-compliance with the legislation of the country where the products are delivered.
The customer is the importer of the products and CYALUME TECHNOLOGIES advises its customers to check if the products sold on its website https://www.cyalume.shop are free to import in their country. Our products are marketed under the following HS Codes: 3824999299, 3921901090, 8505191090, 3923900000.
The products are imported by the customer under his sole responsibility. In case of dispute at the time of receipt and clearance of the imported products, the responsibility of CYALUME TECHNOLOGIES cannot be engaged and the products will not be taken over by CYALUME TECHNOLOGIES.
The offers submitted by CYALUME TECHNOLOGIES are only valid within the limit of available stocks and until they are exhausted. CYALUME TECHNOLOGIES mentions different levels of availability for the products sold online. The frequent updating of the display does not exclude differences. It is recommended to consult the order confirmation emails sent by CYALUME TECHNOLOGIES or to contact the Customer Service.
In case of order of a product which has become unavailable, the customer will be informed of this unavailability as soon as possible by e-mail, by telephone or by post.
The photographs, texts, graphics, information and characteristics reproduced and illustrating the products are not contractual. Consequently, CYALUME TECHNOLOGIES cannot be held responsible for any error or omission in any of these photographs, texts, graphics, information or product features.
The products prices are indicated on the website “all taxes included” (VAT and other taxes applicable on the day of the order) unless otherwise indicated, and excluding processing and shipping costs. CYALUME TECHNOLOGIES reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the price at the order validation time, i.e. on receipt of the payment. In case of an order out of France, the sale is made according to the Delivery At Place (DAP) incoterm.
Customs duties or other local taxes are likely to be due. These fees are the responsibility of the customers in terms of declarations and payments to the relevant authorities of their country. CYALUME TECHNOLOGIES advises its customers to inquire about these aspects with their local authorities.
The fact that the customer confirm his/her order on the site https://www.cyalume.shop constitutes full acceptance of these terms and conditions.
Before this confirmation, he/she will be proposed to check each of his/her order’s elements.
A summary of the order will be sent to the customer via the order confirmation email address. The sale between CYALUME TECHNOLOGIES and the customer will be perfect from the moment CYALUME TECHNOLOGIES has sent the customer an e-mail confirming the availability and shipping of the products.
CYALUME TECHNOLOGIES' very short order preparation times make it impossible for the customer to cancel his/her order for any reason whatsoever. If necessary, the customer has to use his/her right of withdrawal.
The fact that the customer validates his/her order implies the obligation to pay the indicated price. Payment is made by credit card (VISA, MASTERCARD), PayPal or by transfer to the following account (indicating the reference of the order):

The products remain CYALUME TECHNOLOGIES’ ownership until entire payment of the price. The transfer of the risks relating to the products takes place at the time of their delivery. CYALUME TECHNOLOGIES reserves the right to suspend all order management and delivery in case of non-authorization of payment by credit card from the officially accredited bodies or in case of non-payment.
CYALUME TECHNOLOGIES reserves the right to refuse to make a delivery to a customer with whom a dispute is pending.
The payment is fully secured thanks to the online payment system of CYALUME TECHNOLOGIES banking partner, Stripe. The customer's banking data is only circulated on the Internet in encrypted form and is only processed by Stripe: CYALUME TECHNOLOGIES is never in possession of this data. The security system is based on the SSL / TLS protocol. Stripe is certified PCI DSS (Payment Card Industry Data Security Standard).
In case of payment by bank transfer, products will only be shipped after receipt of funds to the bank account of CYALUME TECHNOLOGIES.
The products are delivered to the delivery address indicated during the ordering process. CYALUME TECHNOLOGIES cannot be held responsible for any input errors which would cause delays or errors of delivery. In this context, all expenses incurred for the redirection of the order will be entirely at the customer's expense.
Packages are usually shipped within 2 days after receipt of payment.
In mainland France (including Corsica), parcels are shipped via Colissimo with or without signature or in “Points Relais Service Colissimo” for parcels up to 20 kgs. For all other destinations, the offered shipments are home delivery with signature or in “Points Relais Service Colissimo” for parcels up to 20 kgs and carried out via Colissimo’s partner forwarders.
Regardless of the delivery method selected, a link is sent to track the package online.
The communicated delays are only indicative and CYALUME TECHNOLOGIES cannot be held liable if these delays are exceeded, in particular as a result of disturbances due to carriers or postal services:
Mainland France: 2 days
European Union: 3 to 5 days
International outside EU: 5 to 8 days
In accordance with the law, in case of delayed delivery, the customer can cancel his order under the conditions and modalities defined in article 138-2 of the French Consumer Code.
Shipping costs include preparation and packaging costs as well as postage. The preparation costs are fixed, while the transport costs vary according to the total weight of the package. It is recommended to group all products together in one order. It is not possible to combine two orders placed separately and shipping charges apply to each delivery.
In Metropolitan France, the port is free for any purchase over €90, excepted for the Sustain bags range.
Storage and Liability for use
CYALUME TECHNOLOGIES recommends that the products sold on its website are kept at temperatures between + 5 ° C and + 20 ° C, away from the sun and from any source of heat or cold, UV rays and sudden changes of temperature.
The customer is invited to refer to the description of each product mentioned on its packaging in order to know its own characteristics.
Any legal warranty (if applicable) is excluded if the defect is due to regular use, negligence, misuse or under storage conditions that are defective or not in accordance with the specifications of CYALUME TECHNOLOGIES indicated on the packaging of the products.
CYALUME TECHNOLOGIES complies with the legal withdrawal period of 14 calendar days provided for by Law No. 2014-344 of 17 March 2014 relating to consumption. During this period, the customer may return, at his own expense, products which do not suit him. A return is only possible for unused items and in their original packaging and the return must be made in a new packaging so that the original packaging is not damaged. In general, returned products must be in a perfect state of resale, with all accessories. CYALUME TECHNOLOGIES reserves the right to deduct a percentage of the value of the products in case of damage to the original packaging and/or if the returned products are damaged, broken or used.
The withdrawal period runs from the day of delivery of the order.
Any cancellations and consecutive returns must be reported to the CYALUME TECHNOLOGIES Customer Service by mail or by email (addresses below), indicating the order number. The Customer Service will then send a return voucher to the customer. Without the presence of this voucher, the parcel will be refused.
The refund will only take place once the parcel has been returned to CYALUME TECHNOLOGIES warehouses.
Returns and non-compliance
The customer must check the products on delivery, notably the quality, the quantities, the references of the products and their conformity to the order, and he/she must mention the damages related to the carriage on the delivery note.
The products which were delivered in accordance with the order are so definitively and are neither taken back nor exchanged, within the following limit.
The customer must inform CYALUME TECHNOLOGIES in writing within 2 working days of their delivery in case of non-compliance of the products delivered to the order. After this period, no claim for apparent non-conformity will be accepted by CYALUME TECHNOLOGIES.
Returned items must be unused and in their original packaging and returned in a new package so that the original packaging is not damaged. In general, returned products must be in a perfect state of resale, with all possible accessories. CYALUME TECHNOLOGIES reserves the right to deduct a percentage of the value of the products in case of damage to the original packaging and/or if the returned products are damaged, broken or used.
It is up to the customer to provide any justification to the actual defects found and in particular the lot number of the delivered products.
Any return of products must be beforehand agreed by CYALUME TECHNOLOGIES. Any return without this agreement will not result in the issuing of a credit note or a replacement. For any return, the customer is invited to go to the "Returns" portal https://cyalume.shipping-portal.com/returns to follow the procedure indicated.
The refund will only take place once the parcel has been returned to CYALUME TECHNOLOGIES warehouses.
In the event of non-compliance of the delivered products, duly noted by CYALUME TECHNOLOGIES, the sole responsibility of CYALUME TECHNOLOGIES is limited to the obligation to replace or to refund the products exclusive of any compensation, indemnity or damages in any way whatsoever.
